Cliff notes:

DISCLAIMER : This is based on a quick perusal only.

- The court cannot 'adequately protect' the NHL's claimed rights of franchise location and admission of members if the team is sold to Balsille and moved to Hamilton. If the NHL's rights were upheld later through separate litigation, you can't "unring the bell" and move them back. The statute says that if one party's interests are not 'adequately protected', a sale cannot be allowed. Egro, no ruling on if the NHL has a valid case for restricting who can have a team and where, but simply that if there's a question, he can't let that go through.

- The NHL tried to dictate who would get paid if they purchased the team. The NHL basically said that they'd pay everyone EXCEPT the Moyes and Gretsky groups. The NHL said they'd pay 'all legitimate creditors', with the clear assertion that Moyes and Gretsky are not. The law says that they can't pick and choose who they THINK have legit claims, and those issues would have to be resolved first.

Also of note , PSG was dismissed WITH prejudice, where the NHL was dismissed WITHOUT prejudice. That means PSG's bid is totally dead, but the NHL could amend.

Balsille will not own the Coyotes unless he plays ball with the NHL.

Which means he won't own them.

It looks like the NHL will amend their bid and own them, but then what? Winnipeg?

It doesn't look like Hamilton will be getting an NHL team anytime soon.

Quote:
"We are pleased that the Bankruptcy Court has confirmed the League's rights to select its owners and the location of its franchises,'' Deputy Commissioner Bill Daly said in a statement regarding today's ruling. ''We are reviewing the opinion and considering how we can best address the Court's concerns regarding our offer to purchase the Coyotes. It remains our goal to secure the long-term stability of the Coyotes in Glendale."

I don't know, but apparently the NHL will buy it, and payoff Gretzky, and then sit on it until they can find someone.

But Hamilton will NEVER have a team :violence-smack:

and then open up expansion bids, with the yotes players entering a dispersal draft, with the worst teams getting first cracks, after the expansion team gets first overall cracks.

It's kinda like what they had to do with Buffalo, the NHL just sat on Buffalo until a buyer who was going to keep them in Buffalo was found.

I wonder if Basillie was after our team during that time also?

i figured this would be the outcome. there was no way that anyone with common sense would have awarded ballsilli a team under these conditions.

Gary Bettman was doing his best Wilbert Harrison after Judge Baum killed Balsillie's bid...

Words are words, but I remember Gary saying over the summer that if the NHL were looking at expanding or relocating back to Canada, that Winnipeg would get the team or atleast be given first look. I hope he wasn't just talking shit because he didn't want a team in Hamilton. The 'Peg needs the NHL back. If they can get the proper backing, give them a shot Gary. So what if you have to admit you're wrong. We're only human and it may earn you a shred of respect amongst the fans of not only the great white north, but hockey fans all over NA.

...well, now. Moyes and the Coyotes are screwed.

No money for anyone. And a whole summer spent on this big jerk-off bankruptcy trial.

Eventually, the NHL will just forcibly take over the team, running it in the red until they can blow sunshine up another douchebag's ass, and get him to buy this little abortion.

I'm truly disappointed in Baum's gutless decision. He tried to solve all the problems, and ended up solving none.

Bit off more than he could chew, I reckon.
