I will say this if the person looks like they are not at least 19 i'll have to say no but if they look old enough i'll look at the DOB and turn a blind eye. as well what i don't know can't be used against me. by which i mean people under age have those of age buy them the drink.
The NYS law is that, once the drink leaves the counter, it is no longer the bartenders responsibility. I bar tended for about 5 years, through college, and in the summers. The person who gave the under age person is responsible if they order it and then give it to them.
The establishment hold no liability, as long as they were checking ID's, and they have witnesses stating they were checking IDs.
All in all, it's nothing to even worry about, because I've knowingly served underage people in the bar I worked at, and the police typically just turn a blind eye to it, as long as nobody is excessively hammered.
