Quote:
Last May, Jake Schutter was pitching in a Little League game in suburban Chicago when the batter blasted a line drive back toward the mound. The ball violently hit the 11-year-old on the left side of his head and he immediately started vomiting after falling to the ground.

Today, his family is suing Easton in federal court, claiming that it was the opponents' bat — an Easton BT265 — that was responsible for leaving Jake deaf in his left ear.

really america?

a. thats the chance you take when you step to rubber and pitch. a ball that comes back, comes back really quick.

b. metal bats should be outlawed in every single level of baseball/softball. i prefer a wooden bat.

c. this family is looking for a pay-day.

This isn't the first time this type of suit has happened. It's bullshit.

(I'm with you on the metal bats thing though. Give the kids wood.)

These parents should work for their pay day... let professional ball players hit consistently at the parents with metal bats until the parents go deaf in one ear, then let em sue.

I understand the sentiment.
But when you're talking about college programs, even large established ones, there's not much money there. Going to wood bats would really be costly for them, since they break and would need to be replaced so often.
If we're talking about 11-year olds, on the other hand, then broken bats should be very rare, so there would be nominal extra cost vs. using aluminum bats. However, if youth leagues started outlawing aluminum bats, then Easton would sue them!!!
From a legal standpoint, why just sue the bat company? Sue the company that made the baseball, too! Sue the company that made the batter's batting gloves! Sue the company that made his cleats! Fuck, sue everybody!

Aren't wooden bats heavier? Pretty sure that's part of the reason aluminum bats are used in youth leagues.

mikes ruling:

100,000 dollars to the family for compensation, however, the boy is unable to play baseball, because of injuries.

OR

the league is forced to use wooden bats from here on out, at eastons sponsorship.

Meh, if the family really thought they were dangerous, they wouldn't have let the kid play in the first place. My ruling, put some ice on the ear and don't play in a league and at a position that you can't handle.

On a routine baseball play that happens all the time. If something happens that shouldn't like a broken bat or something, then fine, they have a bit of a leg to stand on, but line drives are a part of baseball. If this kid had enough time to turn his head, he had enough time to get his glove in the way. It suggests to me that he either wasn't confident enough or wasn't skilled enough to be pitching in that league. If the parents thought it was that dangerous, they would not have put their son in that position to begin with.

Well you said put an ice pack on his ear like nothing really bad happened. The parents are retarded. But the kid was hit in the side of the head and threw up. Not something to just ice and forget about.
