Isn't free speech, aka The First Amendment, only in place to prevent the government from impeding on a person's ability to say whatever the hell they want?

If I said something inflammatory (and seriously, who would think telling all members of a certain demographic to leave a store for a seemingly-arbitrary reason isn't inflammatory) over a public address system, I'd expect to not get away with it. And you can be damned sure that if I was a manager somewhere and one of my employees said something like that, I'd rather beat the snot out of the guy rather than just issue some limp-wristed apology.

i understand that, but he doesnt forcefully make anyone leave, just said it. i just dont see how this is a criminal case.

Just my belief, but there is something seriously wrong with her shirt. Man, this is the ultimate irony.

Although it kind of sticks out like a sore thumb (wearing that shirt) upon looking at this pic, neither the two guys nor the nazi seem to be uncomfortable or thrown off by the shirt or the sentiments which go with it. They almost look like they are in the store together?? :?

I don't think what was said is a crime either, just a jackass thing to do.
Since they arrested someone I'm guessing the person wasn't an employee and got nailed for trespassing or something like that.

Freedom of speech does not mean freedom of consequences from that speech.

I'll use the old standby argument: You're free to shout 'fire' in a crowded theater. But, you're responsible for the resulting outcome of what you said, be it injuries or what not.

That being said, I don't think this was criminal, just douchery. They're probably ringing him up on something else.

Walmart, or any other store, can't help if some random kid gets on the PA and makes jackass comments. As far as the charges go, they're just the typical trumped up BS based on the fear of this becoming another PC nightmare. The kid didn't actually say anything threatening, just offensive in a back-handed way. He didn't use vulgarity or any other confrontational language, so it's a stretch to call it racial bias intimidation or harassment.

Obviously the kid needs an ass whipping from the family, but pushing this through the court system is a joke.
