Yes.

60.2 Minor Penalty - Any contact made by a stick on an opponent above the shoulders is prohibited and a minor penalty shall be imposed.

and major if he is cut... its not like he cut himself shaving on the ice.... bush league... fucking refs... and no its not an excuse for some of their garbage play.... they score on the 5 on 3 its a different game! gotta capitalize on those chances... fuckers...
