It depends on what they mean by "pushing" the cop. If he did a little bump to get by the cop, this is bullshit, but most likely he straight up shoved him.

Cross is right, any unwanted touching is a battery (or assault depending on your state). Even if he pushes the officer aside he should be charged. That ass will get virtually nothing for it because of our incompetent judicial system.

My prediction.... no jail time and $500 fine. Off his record in 6 months with good behavior. It's only a friggin misdemeanor in Cali anyway.

The key word is unwanted. I think that it it's perfectly justified.

I don't think he deserves any jail time or anything. Jails are already overcrowded and most people who get jail sentences get them severely shortened in California because of that. To throw him in jail is just a waste of money. Fine him and move on.

It comes down to respecting authority which some people seem to have an issue with and Avery is a prime example of this. He obviously thinks his shit doesn't stink and decided the law doesn't apply to him. The officers did what was appropriate...end of story

He won't be getting jail time, the statute doesn't allow for it

Pushing someone is "assault" or "battery" depending on the wording of a state's statute. Other factors come into play when determining jail time or not. FWIW, when an officer is called about a noise complaint, and then sees (hears) a violation of the noise ordinance with his/her own eyes/ears and can potentially issue a citation, the owner/resident is not free to go back inside or anywhere else against the officer's will, let alone push the officer in the process. In fact, the officer can potentially confiscate the audio equipment causing the noise violation, which would only be returned by a judge's authority pending the adjudication of the case.

Charges against Avery will not be filed. I guess the officer "got his foot caught in his door" instead of actually being battered. Still trying to figure out how that happens.....
