Meh. I don't think that it matters what the school told the kids; it sounds like they just told them to draw anything related to Christmas, which could be anything from a tree to Santa Claus to snowmen to Jesus to presents... The school didn't tell the kids to draw depictions of Christ.

The father's just trying to get money, anyway. With a lawsuit, if it's leaked to the media, sympathies will almost always be extended to the plaintiff. The reputation of the defendant begins to slide, and because typically the people or corporations or businesses etc. that are sued have quite a bit of money, to say the least, settling is $5 to them while going through with fighting it in court is the same, $10 if they do so and lose. Would you rather pay $5 now to save your reputation from any further damage, or wait as your reputation falls more and potentially have to pay $10? It's always disappointing to see no legal precedent set because most suits are settled outside of court regardless of whether the defendant was actually in the wrong (with settlements, typically they weren't), buuuut you know.

I don't think that the father's going to get anywhere, though. He said far too much publically, and as a result, the media's not going to be very sympathetic to his cause if he does decide to sue, and he won't get a settlement out of it. Not smart.

Your right. After reading into it a little more it does seem like a huge publicity stunt by the parents.

Gotta tend to side with the parents here, but either way the kid loses. He either has his own parents lying/fabricating or his own school lying/fabricating. Feel bad for the drama this kid is coming in contact with at such a young age...

I remember in my first grade class we had a Jehova's Witness. He wouldn't partake in any celebrations of any kind, so we usually danced around him and taunted him with our pieces of cake.

Then he told our class there was no Santa and my mom dismembered and ate him. Good times.

I don't see an issue with "class, let's all do something to celebrate the holidays," as long as its not "let's all make christmas cards."

Is there a picture of what he drew? It was probably something weird like hitler as jesus.

He drew a picture of a cross, with a person on it, similar to normal depictions of Jesus' crucifixion. When a teacher asked the child who was on the cross, the child said it was himself. The teacher then alerted the school psychologist and principal.

When I was in the 3-5th grade I had no idea what a swastika was, a few people in the class did but not many. Well we had an art class and part of the curriculum was for us to decorate a folder to hold the art in. One of the students who knew what a swastika was showed it to me and I thought it looked cool, so I painted in black paint on my folder and thought nothing of it, just a cool design. Some of my friends knew what it was and dared me to show the teacher which I did not even understand why it was a dare but I did it anyway. She said "Thats very nice but the principle is Jewish so your going to have to do something else"....At the time I was confused and did something else. A few years later I thought back to that moment and realized that my art teacher was a possible nazi, maybe she was just tolerant of the possibilities of me being a nazi.....eerie

I once drew a picture of a penis with nuts..my parents weren't amused and they didnt stand behind me. Although I must admit, they stood behind me and whooped my ass for drawing a one finger salute to the art teacher. I even added the caption....Smile Mrs.------, I am thinking about you. There were no psychologists when I attended High School, never the less, when I drew a picture of a vagina, I did go see the principle, AND got another ass beatin....seems it was a motif in my childhood...ass whoopins...perhaps therapy is warranted at this point.

No it's not a crime, I'm just saying that in Public Schools, if you call it Easter Break, Christmas Break, or even Thanksgiving Break, you're technically wrong, even if that is what it is.
