the Obama administration has argued that warrantless tracking is permitted because Americans enjoy no "reasonable expectation of privacy" in their--or at least their cell phones'--whereabouts. U.S. Department of Justice lawyers say that "a customer's Fourth Amendment rights are not violated when the phone company reveals to the government its own records" that show where a mobile device placed and received calls.

So everyone whipped up over Bush and his warrantless wiretaps feel free to lodge your complaint below.

I actually lodged my complaint directly to then Senator Obama when I had a chance to ask him a question at a Black church in Eatonville, Florida, where he spoke back in 2005 or 2006. I asked why I should continue supporting Democrats when they were complicit in the worst infringements of our liberties perpetuated by the Republicans.

He indicated that Democrats did have much to answer for and had to do better to earn people's trust. This isn't a good way to do it.

At this point we are not actually talking about pinpoint tracking of people through their cell phones. Phone companies do not keep those kind of records, Hollywood movie thrillers not-withstanding. They only have records of which cell towers were used, indicating a general area where the phone user was. This has been used to track down drug dealers and, in one case, a couple of bankrobbers in Dallas.

I oppose this government snooping, even though it doesn't apply to me as the last man in America without a cell phone.

No one is safe anymore, fuck this trackin shit... I mean did you know that facebook had some grant with the government that once you put stuff on your facebook the government has it no matter what, even if you delete it. Talk about infringing on privacy.

You cut out the part where it said, "In that case..."

The case specifically targeted phone calls that were made around the time of the heist. Is that really a warrantless search?

They aren't reading your text messages, or even listening to your conversations. They're just looking for patterns.

Sure enough, they found that two phones made calls in all 12 robberies right at the times they occurred.

I don't really have a problem with that.

Triangulation between cell towers is quite accurate.
I can turn off the GPS in my blackberry and it can pinpoint my location within 700 yards or so using towers only.

I didn't cut anything out.
Was Bush warrantlessly wiretapping everyone? Innocent people?
No.
They were using warrantless wiretaps on terror suspects in very specific cases and folks on the left got seriously bent out of shape about that. It's pretty much the same thing.
2 consecutive administrations giving the finger to the 4th amendment and the FISA courts.

If you have no problem with these moves by either Bush or Obama then fine.

The Bush administration wasn't just targeting specific people in specific cases.

They were abusing the shit out of the 'National Security Letters' to go on fishing expeditions.

Of course, Obama has stopped that. uh huh.

But it doesn't really matter...those were acts by the bumblers at the FBI. If you're worried about the 4th amendment getting raped turn your attention to the NSA.
You better believe they still have switching gear in wiring closets all over the place.

I still find it amusing, B_B_B_BUSH!

Bush is powerless and alone in Texas right now.
The guy currently in charge kept most of the nasty tools and tactics of the last guy and is now fighting for more.

Is the location of your cell phone private information?

Sorry I wasn't saying that to accuse you of twisting things. I just read it differently.

It appeared to me that trying to find out the times these cell calls were made is different than listening to conversations and reading text messages.

I just don't feel like it's an unnecessary invasion of privacy, especially when it helped them crack a case, and potentially save lives should one of those robberies eventually have turned sour.

A lot of things that could save lives and crack cases are also invasions of privacy.
That's why the 4th amendment exists.

Show me your papers comrade.

Actually the 'National Security Letters' stopped late in the Bush Administration. Well, at least we stopped getting them.

I'm not happy that Obama is continuing these invasion of privacy tactics myself. However, let's not gloss over why they even showed up to begin with.

A little off topic, but in the same vein as "it's creepy how much control we surrender," I've been hearing ads about onstar and how it now has the capabilities to slow and stop your vehicle.

Which is all well and good if your car is stolen, but it doesn't seem like a stretch that the government could make use of such technology. Scary.

....especially since Onstar is a GM product...and GM is 60% owned by the Federal government.

Bush and Obama are probably both members of the same small group of people slowly asserting control over the American People.

The Patriot act, wiretapping, the ability to halt your vehicle and track you via your cell phone...

...hold on, some men in suits are here.

Isn't California pushing for remote control of your thermostat in case of an "energy emergency?"

Yes...I believe you get a tax rebate if you install them.
Of course, if the damn hippies had allowed California to build any new power plants over the last 30 years that wouldn't be necessary.

I don't think so because it can be remotely controlled and monitored.
